Terms and conditions

These terms govern your use of this website and the enquiry form on it. They do not govern any engagement we may later agree — that would be set out in its own signed contract.

1. Who you are dealing with

This website is operated by Iberix Dynamics LLC, a limited liability company organised in New Mexico, United States (New Mexico Business ID 7405251). Iberium is a brand operated by Iberix Dynamics LLC; in these terms "Iberium", "we" and "us" mean Iberix Dynamics LLC. You can reach us in writing through the enquiry form on this site.

By using this website you accept these terms. If you do not accept them, please do not use the site or submit the form.

2. What this website is

This site describes what we do and invites you to tell us about your business. It is information and an invitation to make contact — nothing on it is an offer capable of acceptance, a quote, or a commitment to take on work.

We may change, suspend or withdraw any part of the site at any time without notice.

3. Using the enquiry form

When you submit the form you confirm that:

  • the information you give us is accurate to the best of your knowledge;
  • you are authorised to share it — in particular, that you are not sending us confidential information belonging to someone else, or personal data about third parties, without a lawful basis for doing so;
  • you are contacting us in a business capacity, not as a consumer;
  • you are at least 18 years old.

Please do not send us trade secrets, credentials, special-category personal data or anything under a confidentiality obligation through this form. It is a first contact, not a secure channel. There is time for that once there is an agreement in place.

4. What we do with an enquiry

A person reads what you send and replies. We are not obliged to respond to any enquiry, to take on work, or to give reasons if we decline.

Ideas, suggestions or feedback you send us unprompted are not treated as confidential, and we may use them without restriction or payment. Anything you mark as confidential and send after a confidentiality agreement is in place is governed by that agreement instead.

5. Intellectual property

The design, text, graphics, marks and code of this site belong to us or our licensors. You may read the site and print or download extracts for your own internal business use. You may not copy, republish, adapt or commercially exploit any part of it without our written permission.

6. Availability and accuracy

We take care over what we publish, but the site is provided as it is. We do not warrant that it will be uninterrupted, error-free, or that the information on it is complete or current. Nothing here is professional, legal, financial or technical advice for your particular situation.

7. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under applicable law.

Subject to that, and because this site is a business-to-business information resource, we are not liable for any loss of profit, revenue, business, data, goodwill or anticipated saving, or for any indirect or consequential loss, arising from your use of this site or your reliance on anything published on it.

8. Links to other sites

Where we link elsewhere, it is for information only. We do not control those sites and are not responsible for their content or their handling of your data.

9. Changes to these terms

We may revise these terms. The version published here at the time you use the site is the one that applies, and the date at the top tells you when it last changed.

10. Governing law and forum

These terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules.

The state and federal courts located in New Mexico have non-exclusive jurisdiction over any such dispute. Where the mandatory law of the country you are in gives you protections that cannot be set aside by agreement, nothing in this section removes them.
